Terms & Conditions.

Ensure you thoroughly understand the terms outlined below, as they govern the services provided by Elen Rivas Beauty Clinic to its clients. Kindly read and comprehend these terms before booking any treatments or procedures at Elen Rivas Beauty Clinic.

I. General Terms and Conditions for All Clients

1.1 These terms and conditions constitute the foundation of the agreement between you, the client, and Elen Rivas Beauty Clinic.

1.2 Please meticulously review these terms and our privacy policy. Feel free to address any queries or concerns.

1.3 By registering with us, you explicitly agree to abide by these terms.

II. Appointments, Deposits, and Cancellations

2.1 A non-refundable deposit of £50 is mandatory upon booking, deducted from the treatment cost on the appointment day.

2.2 Elen Rivas Beauty Clinic necessitates a minimum 48 hours' notice for appointment cancellations. Lack of notice and non-attendance nullify your booking refund.

2.3 The clinic won't secure a date for consultation or treatment without a booked appointment.

2.4 Arrival Time

Arrive 15 minutes before your appointment; lateness may result in rescheduling. If delayed, contact Elen Rivas Beauty Clinic. Arrival more than 15 minutes after the scheduled time may lead to cancellation.

2.5 Rescheduling without charge is permissible with at least 48 hours' notice.

2.6 No-shows without notice forfeit the deposit.

2.7 Exceptional circumstances may be considered for waiving charges, at the discretion of the clinic.

2.8 We reserve the right to cancel an appointment due to unavailability of practitioners or materials, or events beyond our control. Full deposit refund will be made.

III. Client Conduct and Clinic Policies

3.1 Retrieve personal items before leaving; the clinic is not responsible for lost belongings.

3.2 Maintain minimal noise during visits; mobiles must be on 'silent.'

3.3 Mobile phones are to be turned off or set to silent mode during visits. Unauthorised videography is prohibited.

3.4 Elen Rivas Beauty Clinic reserves the right to refuse entry or treatment for aggressive or threatening behaviour.

IV. Payment Options

We accept Credit/Debit Cards, Cash, Gift Vouchers, and Bank Transfers, including American Express.

4.2 Prices may change without notice, but booked appointments are exempt from such increases.

4.3 We assure you that credit card details are not stored at Elen Rivas Beauty Clinic.

V. Gift Vouchers

Available at the clinic reception.

Redeemable only for clinic treatments.

Valid for 6 months.

VI. Eligibility for Treatment

6.1 We reserve the right to deny treatment based on suitability or expected success.

6.2 Treatment restrictions apply if under 18, pregnant, breastfeeding, or with medical conditions.

6.3 Treatments adhere to legal and ethical standards.

VII. Children

7.1 Children under 12 must be supervised during their visit, as we do not accommodate them independently.

7.2 Clients with children are responsible for ensuring their good behaviour; disruptions may result in appointment cancellation.

VIII. Refunds

Treatment fees are non-refundable. Additional costs may apply for complications or further treatment.

IX. Product Refunds

9.1 Purchased products are non-refundable unless faulty.

9.2 Faulty products require assessment before refund processing.

X. Risk of Clinical Complications

10.1 Patient well-being is a priority; acknowledge potential risks during consultation.

10.2 Some procedures may have documented complications, discussed during consultation.

XI. Equipment Safety

If there is a malfunction in the equipment, we will initiate the rescheduling of your appointment for safety reasons.

XII. Documents and Records

12.1 Complete a registration form with contact details.

12.2 Medical questionnaires are mandatory, updated during each appointment.

12.3 During each appointment, patients will be requested to review and, if necessary, update their medical questionnaire. Additionally, they will be asked to sign to confirm the accuracy of their provided information.

12.4 All patients will be asked to sign a consent form prior to any treatment. You have the right to change your mind about treatment at any time, even after you have signed the consent form.

12.5 You have the right to request a copy of any documents which we may hold in relation to your care; and which we shall provide at a reasonable fee as determined by us.

XIII. Mental Health Disorders and Aesthetics

13.1 Realistic expectations are vital for aesthetic treatments.

13.2 Disclose emotional health history before treatment.

13.3 Effects on mental health cannot be accurately predicted.

XIV. Data Protection and Privacy Policy

14.1 All personal information that we may use will be collected, processed, and held in accordance with the provisions of EU Regulation 2016/679 General Data Protection Regulation (“GDPR”) / The Data Protection Act 2018 and your rights under the GDPR; For complete details of our collection, processing, storage, and retention of personal data including, but not limited to, the purpose(s) for which personal data is used, the legal basis or bases for using it, details of your rights and how to exercise them, and personal data sharing (where applicable), please refer to our privacy notice available from the clinic manager.

XV. Limitation of Liability

15.1 Elen Rivas Beauty Clinic will not be liable in contract, tort or otherwise for any economical loss (including, without limitation, loss of profit) or for any other special, indirect or consequential loss or damage arising out of, or in connection with, its provision of any services and/or goods to the patient;

15.2 It is the patient’s responsibility to ensure that he or she provides Elen Rivas Beauty Clinic with all the relevant medical details prior to each treatment.

Elen Rivas Beauty Clinic will not be liable for any damage that occurs because of the patient’s failure to disclose such details.

15.3 The patient agrees to comply with all instructions and/or recommendations given to them, or on behalf of Elen Rivas regarding their aftercare. Nothing in these Terms and Conditions shall exclude or limit, Elen Rivas Beauty Clinics liability for death or personal injury as a result of our breach of these Terms and Conditions or as a result of our negligence.

XVI. Complaints

If you have any concerns or complaints about our services, please contact the clinic manager directly following our Complaints Policy. Your feedback is important, and we are dedicated to addressing and resolving issues promptly.

XVII. Changes to Terms and Conditions

We may from time to time change these Terms and Conditions without notice, but an up-to-date version will be available on our website.

XVIII. No Waiver

If we or you do not promptly exercise a right outlined in these Terms and Conditions, it does not mean that we or you have given up that right. Furthermore, overlooking or not addressing a violation of any provision in these Terms and Conditions does not imply that we or you will overlook any subsequent breach, whether related to the same provision or any other provision. Each instance is treated independently, and not enforcing a particular right or provision at a given time does not forfeit the right to enforce it later or in response to a different violation.

XIX. Severance

If any part of these Terms and Conditions is deemed invalid or unenforceable by a competent authority, it will not affect the validity of the remaining provisions. The unaffected parts will continue to be valid and enforceable.

XX. Entire Agreement

20.1 These Terms and Conditions constitute the entire agreement between the parties and supersede and extinguish all previous agreements, promises, assurances, warranties, representations, and understandings between them, whether written or oral, relating to its subject matter.

20.2 Each party acknowledges that in entering these Terms and Conditions it does not rely on and shall have no remedies in respect of any statement, representation, assurance, or warranty (whether made innocently or negligently) that is not set out in the Terms and Conditions. Each party agrees that it shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in the Terms and Conditions.

XXI. Third-Party Rights

21.1 These Terms and Conditions do not confer any rights under the Contracts (Rights of Third Parties) Act 1999 for any third party to enforce any term of the agreement.

XXII. Social Media Consent

22.1 By providing consent, you allow perpetual use of your image in promotional materials.

XXIII. Law and Jurisdiction

23.1 These Terms and Conditions, the Contract, and our relationship (whether contractual or otherwise) will be governed by and interpreted in accordance with the laws of England & Wales.
